1. Acceptance of Terms
By accessing and using ExpressBox logistics services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.
2. Service Description
ExpressBox provides cross-border logistics services including but not limited to:
- Air freight and ocean freight services
- Warehousing and fulfillment services
- E-commerce logistics solutions
- Import and export services
- 3PL (Third-Party Logistics) solutions
- Land transport and express delivery
3. User Responsibilities
3.1 Accurate Information
Users must provide accurate, complete, and current information regarding shipments, including proper packaging, labeling, and documentation.
3.2 Prohibited Items
Users must not ship prohibited or restricted items including:
- Illegal substances and contraband
- Hazardous materials without proper authorization
- Items prohibited by international shipping regulations
- Perishable goods without appropriate packaging
- Counterfeit or copyright-infringing materials
3.3 Packaging Requirements
Customers are responsible for proper packaging of all shipments. ExpressBox is not liable for damage resulting from inadequate packaging.
4. Pricing and Payment
4.1 Quotes and Invoices
All quotes provided are estimates and subject to change based on actual weight, dimensions, and destination. Final invoices will reflect actual charges.
4.2 Payment Terms
Payment is due as per the agreed terms. Late payments may incur additional charges and may result in service suspension.
4.3 Additional Charges
Additional charges may apply for:
- Fuel surcharges
- Customs duties and taxes
- Storage fees beyond free storage period
- Special handling requirements
- Residential or remote area delivery
5. Delivery and Transit Times
Estimated delivery times are approximate and not guaranteed. ExpressBox will make reasonable efforts to meet estimated delivery dates but is not liable for delays due to:
- Customs clearance procedures
- Weather conditions or natural disasters
- Strikes or labor disputes
- Government regulations or restrictions
- Force majeure events
6. Liability and Insurance
6.1 Limitation of Liability
ExpressBox's liability is limited to the declared value of the shipment or the actual value, whichever is lower, with a maximum limit as per applicable law.
6.2 Insurance
Basic insurance coverage is included in standard shipping rates. Additional insurance coverage is available upon request for an extra fee.
6.3 Claims
Claims for loss or damage must be filed within 30 days of delivery or expected delivery date. All claims require proper documentation.
7. Customs and Compliance
Customers are responsible for:
- Providing accurate customs declarations
- Ensuring compliance with import/export regulations
- Paying all applicable duties, taxes, and customs fees
- Obtaining necessary permits and licenses
8. Warehousing Services
8.1 Storage Terms
Warehousing services include a free storage period as specified in the service agreement. Additional storage fees apply thereafter.
8.2 Inventory Management
ExpressBox uses automated systems for inventory tracking. Customers have access to real-time inventory data through our platform.
9. Privacy and Data Protection
ExpressBox is committed to protecting customer data. All personal and business information is handled in accordance with our Privacy Policy and applicable data protection laws.
10. Intellectual Property
All content, trademarks, and materials on the ExpressBox website and platforms are the property of ExpressBox and protected by intellectual property laws.
11. Service Modifications
ExpressBox reserves the right to modify, suspend, or discontinue any service with or without notice. We will make reasonable efforts to notify customers of significant changes.
12. Termination
Either party may terminate services with written notice. Outstanding balances must be settled upon termination. ExpressBox may immediately terminate services for breach of these terms.
13. Dispute Resolution
Any disputes arising from these terms or services provided shall be resolved through:
- Good faith negotiation between parties
- Mediation if negotiation fails
- Arbitration or litigation as a last resort
14. Governing Law
These Terms and Conditions are governed by the laws of India. Any legal proceedings shall be subject to the exclusive jurisdiction of courts in Lucknow, Uttar Pradesh.
15. Force Majeure
ExpressBox is not liable for failure to perform obligations due to circumstances beyond reasonable control, including natural disasters, war, terrorism, pandemics, or government actions.
16. Entire Agreement
These Terms and Conditions, along with our Privacy Policy and service-specific agreements, constitute the entire agreement between ExpressBox and the customer.
17. Amendments
ExpressBox reserves the right to update these Terms and Conditions at any time. Continued use of services after changes constitutes acceptance of modified terms.
